Resumo

A proteção que uma Constituição destina ao seu meio ambiente do trabalho, sob a perspectiva das interdependências do sistema social envolvente é, em última análise, a defesa que ela defi ne em caráter jurídico aos seus trabalhadores, bem como é a ordem que impõe às empresas quanto às obrigações relativas à eliminação ou controle total dos riscos laborais. Compreender essa dinâmica constitucional ao meio ambiente do trabalho e ao trabalhador – a partir de uma abordagem descritiva e explicativa das normas constitucionais, infraconstitucionais e jurisprudência – é a fi nalidade doutrinária deste artigo, cujo objetivo processual é saber se a Justiça do Trabalho possui competência material às ações regressivas do Instituto Nacional do Seguro Social (INSS) contra empresas, nos casos de negligência quanto às normas padrão de segurança e higiene do trabalho.

Abstract

The protection that a constitution assigns to its environment of work, from the perspective of the interdependencies of the surrounding social system, is, ultimately,the defense that it defi nes in legal terms to its workers, as well as the order which it imposes on undertakings as regards the obligations relating to the disposal or full control of occupational hazards. Understanding this constitutional dynamic to the work environment and to the worker – on the basis of a descriptive and explanatory approach to constitutional, infra-constitutional and case-law – is the doctrinal purpose of this article, whose procedural objective is to know if the Labor Court has material competence to the regressive actions of the National Institute of Social Security (INSS) against companies, n cases of negligence regarding the standard norms of safety and hygiene of the work.
